Who pays for the lease preparation costs in SA? Under the Retail and Commercial Leases Act 1995, the landlord cannot pass on more than half of preparatory costs (which includes lease preparation costs) to the tenant in a retail lease — and this is significantly different to standard non-retail commercial arrangements where parties negotiate who pays legal costs.

What is a "Going Concern" regarding GST? If you purchase commercial property that is currently tenanted and operating as a business, you may be able to treat the sale as a "Going Concern." This can often exempt the transaction from GST, saving you on the purchase price. We recommend speaking to your accountant and us before signing.
